Missouri PSC Staff Ask for Removal of Insurance Requirements

MISSOURIOn January 16, 2009 Missouri Public Service Commission Staff (PSC) filed a Motion for Final Order of Rulemaking regarding liability insurance requirements that were imposed under PSC rules in October 2008. In amending the net metering rule, the Commission included certain liability insurance requirements that it “now believes are undesirable and contrary to the purposes of the statute that granted the rulemaking authority.” Missouri law requires a state agency to find, based upon substantial evidence on the record, that a rule is necessary to carry out the purposes of the statute that granted the rulemaking authority. Staff requested in the Motion that the Commission amend the PSC rule to make it compliant with the Net Metering and Easy Connection Act. The October PSC rules specified that customers with systems 10 kW or less must carry at least $100,000 of liability insurance, which may be in the form of an existing policy or an endorsement on an existing policy. Customers with systems greater 10 kW must carry at least $1,000,000 of liability insurance. See Case EX-2009-0267 for the Motion.
