On May 30, 2008, the Kentucky Public Service Commission announced that it will open Docket 2008-00169 to develop new net metering rules, in compliance with S.B. 83, discussed below.
On April 24, 2008, Governor Steve Beshear enacted a new net metering law (S.B. 83). Highlights: eligible capacity limit is increased from 15 kW to 30 kW; eligible types of renewables now include solar, wind, biomass, and hydro; credits can be carried over indefinitely for the life of the customer’s account, but no residual cash payment will be made for excess credits if a customer closes his account; and the PSC may limit each utility’s total net metering capacity to 1 percent of the prior year’s peak load. The PSC has six months to develop its rules, and the utilities have 90 days thereafter to file tariffs.
