MISSOURI – On February 20, the Missouri Public Service Commission (PSC) filed a Certification of Administrative Rule regarding a proposed amendment to Missouri’s recent net metering regulations. The proposal changes only net metering and interconnection aspects regarding previously imposed liability insurance requirements. The amendment would require customer-generators with systems 10 kW or greater to carry no less than $100,000 in liability insurance, which may be in the form of an endorsement on an existing policy. Customers with systems 10 kW and under may not be required to carry liability insurance; however, interconnection agreements may contain language that indemnifies utilities against liability for damage (except in the case of fault or wrongdoing on the part of the utility). Furthermore, the agreement may contain language stating that the customer may have legal liabilities not covered under their existing policy, in the case of negligence or wrongful conduct on the part of the customer. Attached to the proposed amendment was an affidavit certifying that the amendment would not cause any undue financial burden on small businesses wishing to interconnect.
