On May 10, 2010, Utah HB 145 becomes effective. This bill hanged the net metering language by broadening the definition of a customer generation system to remove a requirement that the system be owned or leased by the utility customer. The bill also allows renewable energy Power Purchase Agreements (PPAs) for state agencies (county, municipality, city, town, other political subdivision, local district, special service district, state institution of higher education, school district, charter school, or any entity within the state system of public education) and 501(c)(3)charitable organizations. These customers must engage in net metering to be eligible for a PPA arrangement. PPAs are a great way for non-profit and other non-tax-paying entities to take advantage of renewable energy tax credits.
